Swiss Temp Agency Compliance Checklist
Switzerland regulates temporary staffing tightly. Miss one of these and you risk fines, revoked licences and reputational damage.
Licences & registration
- Cantonal personnel-services licence (Personalverleih) in every canton you operate.
- Federal permit where required for cross-cantonal or international placement.
- Commercial register (Handelsregister) entry and a valid Swiss legal form.
Workers
- Valid residence/work permits (B, C, G, L, F, S) with tracked expiry.
- Written employment contracts for every temp.
- Correct application of the staffing CBA (GAV) wage scales and premiums.
Payroll
- AHV/IV/EO, ALV, BVG, accident and withholding tax at correct rates.
- Accrued holiday pay and 13th salary.
- Client-approved timesheets as the basis of pay.
Data protection
- Swiss FADP (and GDPR where it applies) compliance for candidate data.
- Explicit consent for storing personal data and documents.
- Right-to-be-forgotten / data export capability.
Audit readiness
- Clean per-employee records and a payroll audit trail.
- Document expiry alerts so nothing lapses silently.
